The Archer City Municipal Court was reconvened last Thursday afternoon at 2pm by Municipal Court Judge Michael Whalen. On July 26 the first ever Archer City Municipal Court jury trial was set in a case involving a dog at large citation, a Class C Misdemeanor, issued to John Bryan Whitaker, the dog’s owner. The inability to seat a jury forced a postponement until last Thursday.
The venue for the trial was changed from Archer City Council Chambers to the 97th District Court. The 6 person jury panel was selected from the pool of 37 potential jurors who appeared in the courtroom. A far greater number of Jury Summonses were issued this time around to ensure a jury could be seated.
Once the jury was seated the trial got underway. Stacie White, the prosecuting attorney, called Police Chief Justin Perron to the stand as her only witness. He testified to facts regarding the issuance of the citation. Mr. Whitaker, representing himself without counsel, took the stand to tell his side of the story regarding the issuance of the dog at large citation.
It took the jury five minutes to find Mr. Whitaker guilty of the offense. The fine for the citation was set by the jury at $250. Mr. Whitaker made arrangement for payment of the fine with Judge Whalen and the court was adjourned.
